Candice Lau

Candice commenced full practice in 2019. She is developing a broad civil litigation practice, having appeared in various levels of the courts in Hong Kong, either as sole advocate or junior counsel. She has experience in handling cases concerning commercial, company, securities and regulatory, professional negligence, trusts, and employment matters.

Prior to joining the Bar, Candice read business and law at The University of Hong Kong, graduating with an LLB with first-class honours. Thereafter, she obtained her Master of Law (Commercial Law) from the University of Cambridge.

Candice is also a part-time tutor at the University of Hong Kong, and the contributing author of various publications, including the latest update of the Annotated Ordinances of Hong Kong: Securities and Futures Ordinance (Cap 571).

Candice has since 2021 served on the Young Barristers Committee of the Hong Kong Bar Association, and is responsible for overseeing its Street Law outreach program.

Candice was awarded the Charles Ching Memorial Scholarship in 2019.

General Civil Commercial

  • Alltogether Land Co Ltd v China Create Capital Ltd [2022] HKCFI 2726 – acted for the 1st Defendant in applying for variation of a Mareva injunction (as sole advocate)
  • Jin Jiang Investment Limited v 深圳市威廉金融控股有限公司 [2022] HKCFI 378 – acted for the 3rd and 4th Defendants in resisting a Mareva and proprietary injunction, and in applying for variation of the Mareva injunction (with Ms. Elizabeth Cheung)
  • Omaha Investments Limited v WH International Logistics Limited, HCA 2131/2019 and HCA 1238/2020 – third party notice stayed in favour of dispute resolution clause; successfully obtained an indemnity costs order against the plaintiffs (as sole advocate)
  • Calm Ocean Shipping S.A. v Win Goal Trading Ltd and others [2020] HKCFI 801 – successfully defended a representative action application (with Ms. Elizabeth Cheung)
  • Cheung Siu Lin v Shun Seng Hop Yick Knitting Factory and Au Wing Chor [2021] HKCFI 120 – succeeded in all debt claims and counterclaims after a 10-day trial (with Ms. Elizabeth Cheung)

Company & Shareholder

  • Re Remote Automation Monitoring Limited [2023] HKCFI 2699 – acted for the petitioner/plaintiff in a 16-day trial of unfair prejudice petition and a concurrent writ action (with Ms. Elizabeth Cheung); [2023] HKCFI 2700 – successfully resisted the defendants’ application for security for costs (as sole advocate)
  • Gentle Soar Ltd v CMBC Capital Finance Ltd [2021] HKCFI 3450, [2021] HKCFI 2775 – successfully resisted an interlocutory injunction which sought to restrain the defendants from dealing with shares in a listed company and exercising their voting rights (led by Mr. Victor Dawes SC, with Mr. Bernard Mak and Mr. Bryan Lee)
  • Masterveyor Holdings Limited v Gao Yunhong, HCA 704/2021 – successfully obtained an interim-interim injunction to restrain the defendants from acting on a set of purported board resolutions to change the board composition of a listed company (led by Mr. Victor Dawes SC, with Mr. Bernard Mak and Mr. Bryan Lee)

Securities and Regulatory

  • HKSAR v Tam Cheuk Hang, HCCC 115/2021 – acting for one of the defendants in defending a criminal charge of conspiracy to carry out false trading (with Mr. Bernard Mak) (ongoing)

Professional Negligence

  • Deepak Pagarani v Haldanes Solicitors & Notaries (a firm), HCA 492/2020 –successfully defended a split trial application in a professional negligence case (with Ms. Elizabeth Cheung)
  • Credit One Finance Ltd v Yeung Kwok Chi [2020] HKCFI 2450 – successfully defended a firm of solicitors from negligence and fraud claims after a 6-day trial (with Ms. Elizabeth Cheung); [2020] HKCFI 3046 – hearing on costs (as sole advocate)

Trust and Probate

  • Cheung Wei Ming and others v Lam Shui Chun, the Administratrix of the estate of Lin Shiue Kiang, Allan, deceased, HCA 1819/2016 – acted for the defendant widow in a 10-day trial of a dispute amongst family members over the beneficial ownership of various properties (with Mr. Ken TC Lee) (ongoing)

Employment

  • Anthony Mackay v Chi-X Asia Pacific Holdings Ltd [2023] HKCFI 938 – acted for the plaintiff in seeking various reliefs against former employer; obtained partial summary judgment (as sole advocate)
  • Lo Wai Keung v Hannover Rück Se [2023] HKCFI 420 – successfully struck out the plaintiff’s claim for falling out of the jurisdiction of the High Court (as sole advocate)

Land

  • IO of Kam Tao Ngan Tao and Hoi Tao Buildings v Fair Charter Investments Limited [2023] HKLdT 32 – acted for the respondents in a trial defending IO’s claim for contributions for renovation works based on undivided shares (with Ms. Joyce Lai)
